2. Judge Sanctions CFTC Over Conduct in My Forex Funds Case

A federal judge in Washington, U.S. District Judge Edward Kiel, has dismissed a 2023 lawsuit brought by the Commodity Futures Trading Commission (CFTC) against Traders Global Group, also known as My Forex Funds, citing bad faith and false statements by the agency. The judge also sanctioned the CFTC by awarding attorney fees to the trading firm. The case alleged that My Forex Funds and CEO Murtuza Kazmi fraudulently collected over $310 million in fees and transferred C$31.5 million to an unknown foreign account. However, a court-appointed special master’s report revealed that the CFTC had received prior confirmation from the Ontario Securities Commission that the transfer was a legitimate tax payment but failed to disclose this information to the court until months later. The report criticized the CFTC for willful misconduct and lack of candor, including an attorney’s admission of being “careless and sloppy.” Acting CFTC Chairman Caroline Pham acknowledged the agency’s misconduct and committed to taking corrective action to restore credibility.
